License Agreement

While installing this software the following License Agreement is made between
you, the Licensee, and BSK Datentechnik GmbH, "BSK":

1. Object
The object of this agreement is the computer program including all provided files, 
the description and the instruction manual for it and other accompanying written
material, together the "Software". BSK emphasizes that according to the current
status of technology it is not possible to guarantee that the licensed computer
program will work correctly in every combination or application.
The object of this agreement is therefore only a Software that works basically
within the meaning of the description and the instruction manual.
The use of the Software for special tasks as defined by the Licensee or the use
of the Software on special hardware used by the Licensee do not fall under this
restriction.

2. Term of the agreement
The agreement is not limited in time. If the Licensee acts contrary to the
clauses of this agreement, he forfeits his right of use. In this case he is
obliged to destroy or return to BSK at request the original data media, any
existing copies, the installed Software including any modified versions as well
as the written material.

3. Scope of use
For the term of the agreement BSK grants the single, non-exclusive and personal
right - hereinafter called "License" - to use the enclosed Software on a single
computer.

The Licensee may transfer the software that is saved on a data medium from one
computer to an other, if it's made sure that at the same time to a single
License only one installation of the Software is used. Two or more installations
of the Software are inadmissible.

4. Special restrictions
The Licensee may not
- give the Software or the accompanying written material without BSK’s written
consent to third persons or grant third persons access to it,
- transfer the Software by a net or a transfer channel to other computers,
- modify, translate, analyse, decompile or disassemble the Software,
- create derived works or copy, translate or modify the written material or
create works that derive from the written material.

5. Ownership of rights
With the purchase the Licensee acquires the ownership of the physical data
medium (disk, paper) but not any rights to the Software itself. BSK remains the
exclusive owner of the rights. In particular, BSK reserves all rights to
publish, copy, work on and make use of the Software.

6. Copies
The Software is protected by copyright in favour of BSK. The Licensee is allowed
to make backup copies. The Licensee has the obligation to indicate BSK’s
copyright on the backup copies. Copyright notes and registration numbers on the
Software may not be deleted. It is expressly forbidden to copy the Software and
the written material in whole or in part in the original or in a modified
version or mixed with other software or included in other software.

7. Transfer of the right of use
In principle it is forbidden to give the Software to third persons. The Licensee 
is only allowed with BSK’s consent to give the Software to third persons or to 
use the Software on behalf of third persons.
Under no conditions the license file received for own purposes is allowed to 
be given to third persons.
As far as the Licensee has owned the right to build applications that base on 
a runtime package, this application may be given to third persons in strict 
combination with the runtime package and the license file particularly issued 
for the Licensee. The Licensee himself binds the receiver of the 
application not to use the delivery to other than the intended purposes.
The actual runtime package including the runtime license file belonging to it 
must never be given to third persons without the belonging application.

8. Liability in case of  breach of agreement
The Licensee is liable for every damage or loss that occurs to BSK due to a
breach of one of the clauses of this agreement.

9. Modifications and Updates
BSK is entitled to update the Software in its own discretion and to produce new
or corrected versions. In this case the Software is only exchanged or updated at
the request of the Licensee against payment to BSK of the respective fee. If an
update has been agreed in writing at the purchase of the Software, the updates
for the agreed term are free of charge.

10. Warranties and liability of BSK
BSK Datentechnik GmbH warrants to the Licensee that the data medium on which the
computer program is saved is correct at the moment of handing-over under normal
conditions.
If the data medium is defective the purchaser can ask for replacement within 2
years from delivery on the condition that the defective data medium and a copy
of the invoice are returned.
If a defect as described above is not cured by a replacement within a reasonable
delay the Licensee can request reduction of the agreement. If the Software
cannot be used within the meaning of 1., the Licensee has the right to annul the
agreement.
Any further liability of BSK for the proper functioning of the Software is
excluded. In particular, BSK does not warrant that the Software meets the
purchaser’s requirements and purposes or that it works together with programs or
hardware combinations chosen by him.
The liability for damages occurring to the Licensee is excluded, except that the
damage has been caused by intent or gross negligence on the part of BSK.
If BSK warrants a special quality of the Software in a single case, the
liability resulting from this warranty does not extend to consequential damage
which is not within the scope of the warranty.

11. Utilized third party software
This software is carefully designed preserving the rights of third party
software developers. These are in particular:

The Licensee is obliged to use this software in a way where none of the legal 
rights of the named third party software developers are violated.


This agreement shall be governed by, and constructed in accordance with, the laws
of the Federal Republic of Germany. Place of performance shall be the registered
office of BSK. Place of jurisdiction shall be Giessen, Federal Republic of Germany.
